Every news cycle seems to bring to light another data breach, ransomware extortion, supply chain attack, or mass cyber-vulnerability. Colonial Pipeline; CNA; Facebook; Microsoft; Log4j. The list is long and varied. Compounded by mandatory breach reporting required by U.S. breach notice laws and the GDPR’s 72-hour breach notification regime, privacy and security litigation in consumer cases is increasing. While not as publicized, however, business-to-business disputes arising from cybercrime and security incidents between companies are also on the rise. This program will discuss the current and coming wave of data privacy and security disputes between businesses, the contexts in which they occur, the legal claims and defenses typically asserted in these cases, and how ADR is uniquely situated to address these issues.
